So if the judge doesn’t know if the guy did the crime or not he will convict him anyway?

That is not the correct characterisation of what I was trying to say.
If the person posting is unsure as to the legitimacy of their post then they probably shouldn’t make the post.
If the post gets flagged then the moderator makes a judgement call as to whether or not the post in question falls within the Code of Conduct.

Exactly. It is a judgement call from a human being who is trying to do their best for all of us.
So take it on the chin, learn from it, don’t do it again. 
It is actually pretty easy to find a reason to flag the post of someone that disagrees with you to censor them.
